By accessing or using the Trekkership website at trekkership.online ("Website") or by booking any tour or service with Trekkership ("we", "our", "us"), you ("you", "the Client") agree to be legally bound by these Terms of Service ("Terms") in their entirety.

If you do not agree with any part of these Terms, you must immediately discontinue use of our Website and must not book any of our services. These Terms apply to all visitors, users, and clients.

Please read these Terms carefully before making any booking. They contain important information about your rights, responsibilities, cancellation and refund policies, and liability limitations.

3.1 Permitted Use

You may use our Website for lawful purposes to browse our tour offerings, read our blog content, submit enquiries, and make bookings. You agree not to use our Website in any way that:

We endeavour to keep the information on our Website accurate and up to date. However, we make no warranties or representations that the content on our Website is complete, accurate, or current. Pricing, availability, and itinerary details are subject to change without notice. Confirmed details are always those stated in your final booking confirmation.

4. Bookings and Reservations

4.1 Enquiry vs Confirmed Booking

Submitting a contact form or enquiry on our Website does not constitute a confirmed booking. A booking is only confirmed when you have received a written booking confirmation from Trekkership and paid the required deposit.

4.2 Booking Process

To make a confirmed booking, the following steps are required:

  1. Submit a booking enquiry via our contact form or by emailing contact@trekkership.online
  2. Receive and review a detailed quotation and itinerary from our team
  3. Return a signed booking form confirming your acceptance of these Terms
  4. Pay the required deposit (typically 25% of the total tour price)
  5. Receive your written booking confirmation from Trekkership

4.3 Accuracy of Information Provided

You are responsible for ensuring that all information provided at the time of booking — including names, contact details, passport information, medical conditions, and dietary requirements — is complete and accurate. Trekkership accepts no responsibility for issues arising from inaccurate or incomplete information provided by the client.

4.4 Minimum Age

All bookings must be made by a person aged 18 or over. Clients under 18 must have the written consent of a parent or legal guardian, who must also accept these Terms on the minor's behalf.

5. Pricing and Payment

5.1 Pricing

All prices displayed on our Website are quoted in US Dollars (USD) per person unless otherwise stated, and are based on the group sizes and conditions stated at the time of enquiry. Prices are subject to change until a booking is confirmed in writing.

5.2 What Is Included

Each tour's inclusion and exclusion list is detailed on the respective tour page and in your booking confirmation. Prices generally include: guide fees, group permits, stated accommodation, stated meals, and group transportation as described. They generally exclude: international flights, personal travel insurance, visas, personal gear, and personal expenditure.

Payment is accepted in USD via bank transfer or other methods as agreed at the time of booking. All bank charges associated with international transfers are the responsibility of the client.

5.5 Price Increases

Once a booking is confirmed and deposit paid, Trekkership reserves the right to increase prices only in cases of significant currency fluctuation (greater than 10%), substantial increases in fuel surcharges, or changes in government taxes or entry fees. We will provide at least 30 days' notice of any price increase. If the increase exceeds 8% of the original price, the client may cancel without penalty.

6. Cancellations and Refunds

6.1 Cancellation by the Client

If you wish to cancel your booking, you must notify us in writing to contact@trekkership.online. Cancellation fees are calculated as a percentage of the total tour price based on the number of days prior to departure at which written notice is received:

We strongly recommend purchasing comprehensive travel insurance that covers cancellation for any reason. Cancellation fees can be significant, and many circumstances that prevent travel (illness, family emergency, visa denial) are typically covered by a good travel insurance policy.

6.2 Cancellation by Trekkership

Trekkership reserves the right to cancel a tour in the following circumstances:

In the event of cancellation by Trekkership for reasons other than force majeure, we will offer clients either a full refund of all monies paid or the option to transfer to an alternative tour of equivalent value. In force majeure cancellations, we will refund all recoverable costs but cannot guarantee a full refund where costs have been irrecoverably committed to third-party suppliers.

6.3 Tour Modifications

Trekkership reserves the right to modify itineraries where necessary due to weather conditions, trail closures, safety concerns, or other circumstances beyond our control. We will endeavour to maintain the spirit of the original itinerary and notify clients of significant changes as soon as practicable. Minor changes to daily schedules, accommodation, or route details do not constitute grounds for cancellation or refund.

7. Travel Insurance

Comprehensive travel insurance is mandatory for all Trekkership clients. Your policy must include as a minimum:

You must provide proof of adequate insurance cover prior to departure. Trekkership accepts no liability for any loss, injury, or expenses that would have been covered by appropriate travel insurance. Helicopter evacuation from remote trekking areas can cost $3,000 to $15,000 USD — without insurance this is entirely the client's personal financial responsibility.

8. Health, Fitness, and Medical Requirements

8.1 Physical Fitness

Trekking involves sustained physical activity, often at altitude, over multiple consecutive days. By booking a trek with us, you confirm that you are in good physical health and fitness appropriate for the demands of the specific trek you have booked. We are happy to advise on fitness requirements — please ask our team at the time of enquiry.

8.2 Medical Disclosure

You must disclose to us in writing any medical conditions, physical limitations, allergies, dietary requirements, or medications that may be relevant to your participation in the tour. This includes but is not limited to: heart conditions, respiratory conditions, diabetes, epilepsy, mental health conditions, previous altitude sickness, pregnancy, or any recent surgery or injury.

Failure to disclose relevant medical information may result in your exclusion from the tour without refund, in the interests of your safety and that of other group members.

8.3 Medical Assessment

We strongly recommend consulting your doctor or a travel health specialist before booking any high-altitude trek. For treks above 4,000m, a specific altitude medicine consultation is advisable. We recommend discussing the use of acetazolamide (Diamox) with your doctor prior to departure.

8.4 Right to Exclude

Our guides have the authority to exclude any client from continuing the trek at any point if, in their professional judgement, that client's health, safety, or the safety of other group members requires it. In such cases, no refund will be provided for unused portions of the tour, and the costs of any necessary evacuation or medical treatment are the client's responsibility.

9. Liability and Risk

9.1 Inherent Risks of Adventure Travel

Adventure trekking — particularly at high altitude — involves inherent risks that cannot be fully eliminated. These include but are not limited to: altitude sickness, extreme weather, trail accidents, landslides, avalanches, wildlife encounters, illness, and equipment failure. By booking with Trekkership, you acknowledge and accept these inherent risks.

Clients are responsible for: complying with all instructions given by Trekkership guides; taking reasonable care for their own health and safety and that of others in the group; any damage caused to property by their own negligence or wilful misconduct; ensuring they hold valid travel documents including passports, visas, and permits; and arranging adequate travel insurance as specified in Section 7.

All clients are expected to treat fellow trekkers, guides, local communities, and the natural environment with respect throughout the tour. Trekkership reserves the right to remove from the tour, at the client's own expense and without refund, any client who:

Clients who wilfully damage the environment or violate conservation rules may be excluded from the tour without refund and may be subject to fines imposed by local authorities.

12. Intellectual Property

All content on the Trekkership website — including text, photographs, graphics, logos, blog articles, itineraries, and design — is the intellectual property of Trekkership and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written permission. Limited use for personal, non-commercial reference is permitted provided attribution to Trekkership is clearly given.

Your use of our Website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept the terms of our Privacy Policy. Please read it carefully.

14. Dispute Resolution

14.1 Complaints

If you have a complaint about any aspect of your tour or our services, please raise it with your guide in the first instance so that we have the opportunity to resolve the issue during the tour. If the matter cannot be resolved on the ground, please submit a written complaint to contact@trekkership.online within 30 days of the completion of your tour. We will acknowledge your complaint within 5 business days and aim to provide a full response within 28 days.

14.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms that cannot be resolved by mutual agreement shall be subject to the exclusive jurisdiction of the courts of the State of Florida.

15. Modifications to These Terms

Trekkership reserves the right to update or modify these Terms at any time. We will update the "Last updated" date at the top of this page when changes are made. Material changes will be communicated to clients with active bookings by email. Your continued use of our Website or services after changes are posted constitutes acceptance of the revised Terms.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
